David Marco Riquelme from DG COMP will give a presentation on “How to deal successfully with FSR filings: Lessons from the recent investigations and what to expect from the forthcoming guidelines”.
Since the entrance into force of the Foreign Subsidies Regulation (‘FSR’) in July 2023, the European Commission has tried to tackle and address distortions caused by foreign subsidies in the internal market. Recent investigations have shown that FSR is an aspect to be taken into due consideration in a pre-transaction stage by business and practitioners. Now more than ever, foreign subsidies are under the scrutiny of the EU enforcer.
David Marco Riquelme will provide the key tips to successfully complete a FSR filing and face FSR investigations. How to complete the form FS-CO, information required, criteria considered by the Commission in its assessment are only some of the many aspects which will be discussed during the talk. Moreover, on 25 March 2025, the Commission launched a call for evidences to collect stakeholders’ feedback on objectives, scope and context of the upcoming guidelines regarding the implementation of the FSR (‘Guidelines’)(closed on 2 April 2025), together with parallel targeted consultations with Member States and selected stakeholders. The Guidelines aims at clarifying the main concepts for assessing the impact of foreign subsidies and will also cover the application of the Commission’s power to request the prior notification of concentrations or of foreign financial contributions received in public procurement. David will provide an overview of the feedback received so far and will present how these may be included in the Guidelines and what they can mean for the future enforcement.
David Marco Riquelme is Case Handler and Economist responsible for foreign subsidies at the European Commission’s DG COMP. David has been involved in various FSR cases and is currently working on the Commission’s draft Guidelines on FSR. He has previously worked in State aid in financial institutions in DG COMP. Prior to joining DG COMP, he worked as a bank resolution expert in the European Banking Union’s resolution authority and in economic analysis and statistics within DG ECFIN. He holds a MSc in economics from the University of Sussex (in UK) and a bachelor degree in economics, from the Universidad Carlos III de Madrid (in Spain).
Lunch will be provided at 12:30, the presentation will begin at 13:00 and will close at 14:00.
