antitrustitalia Competition Lunch Talk with Brice Allibert and Vera Pozzato on “Article 102 in motion – Lessons from the recent judgments on exclusionary abuses of dominance”

Dear Friends,

Antitrustitalia is pleased to invite you to its next Competition Lunch Talk, which will take place on Monday 18 November 2024 from 12:15 to 14:00 at the auditorium of the European Commission’s Directorate General for Competition (DG COMP) in Brussels, Place Madou 1, 1210 Saint-Josse-ten-Noode (Metro Madou).

Brice Allibert and Vera Pozzato from DG COMP will give a presentation on “Article 102 in motion – Lessons from the recent judgments on exclusionary abuses of dominance”.

Recent months have seen a wave of landmark judgments by the EU Courts on Commission decisions concerning exclusionary abuses of dominance, such as Google Shopping, Google AdSense, Qualcomm and, most recently, Intel. The judgments cover different types of unilateral conduct in the tech/digital sectors and provide guidance on some fundamental notions of Article 102, such as the deviation from competition on the merits and the analysis of anti-competitive effects. Brice and Vera will present the key elements of the judgments and explain how they contribute to the evolution of the case law on exclusionary abuses of dominance. Against this background, they will reflect on what these judgments may mean for the future enforcement and interpretation of Article 102, also against the background of the Commission’s draft guidelines published last Summer.

Brice Allibert is Head of the Unit responsible for Antitrust in Information Industries, Consumer Electronics & Internet at the European Commission’s DG COMP. He has previously worked in particular on the Intel, Google (Shopping and Android) and Qualcomm cases. Prior to joining the European Commission in 2000, he worked as a specialist of aircraft electromagnetics in the French Ministry of Defence. He holds a Ph.D. in Mathematics from the Ecole Polytechnique, in Paris.

Vera Pozzato is a senior policy officer in the unit responsible for antitrust case support and policy at the European Commission’s DG COMP. She is a legal professional with 10+ experience in merger control, antitrust and state aid at the European Commission. Vera has, in particular, been involved in various digital antitrust cases and is currently working on the Commission’s draft Guidelines on exclusionary abuses.

Lunch will be provided at 12:30, the presentation will begin at 13:00 and will close at 14:00.
